Assessment Report on the Implementation of Anti-Corruption Measures for the Justice System – Judiciary Subsystem

The Agency for the Prevention of Corruption, in collaboration with UNDP Montenegro, has developed a Methodology for Assessing the Implementation of Anti-Corruption Measures as a new tool in the fight against corruption. The purpose of the methodology is to assess whether government bodies are implementing anti-corruption measures, or to what extent their application has led to specific changes, as well as to encourage government bodies to be proactive when planning and implementing anti-corruption measures that are not prescribed as mandatory.
After the pilot assessments of the implementation of anti-corruption measures in the sectors of public administration and other government bodies, as well as social and child protection, the second phase of the assessment was carried out for the system "Judiciary" and the subsystems "Courts" and "Prosecution." When developing methodologies for these systems, the recommendations provided in the description of the methodology "Assessment of Anti-Corruption Initiatives," conducted by the Anti-Corruption and Civil Rights Commission of the Republic of Korea, were taken into account.
The report for the "Judiciary" subsystem covers 27 government bodies: 26 courts and the Judicial Council, and the results within four categories in which measures were taken in the area of managing corruption risks. At the end of the report, recommendations are provided to guide decision-makers at the judiciary level on the areas where systemic weaknesses were identified and how to respond to them.
For the development of the methodology and the report on the assessment of the implementation of anti-corruption measures, the Government of the Republic of Korea provided support to UNDP. During this activity, the Agency for the Prevention of Corruption was supported by consultants Dragana Krunić and Marko Sošić.
