The Mediation Practical Guide provides clear, systematic, and practical information on the mediation principles and process, participant roles, and the legal implications of settlement.
Designed to support the wider and more effective use of mediation, the Guide explains this voluntary and collaborative approach to resolving disputes, offering a reliable resource to those who use mediation and professionals involved in the process, including mediators, lawyers and members of the judiciary. It supports informed, safe and responsible decision-making throughout the mediation process.
The Guide outlines the general and conceptual framework of mediation, as well as the applicable rules under Georgian law. It covers private and judicial mediation, institutional mechanisms and the enforcement of mediated settlements.
Particular attention is given to judicial mediation, the protection of parties’ rights and limitations on the use of mediation.
The Guide also addresses sensitive areas, including family mediation, women’s and children’s rights, and appropriate responses to signs of violence.
