This is the first edition of the Compendium of selected cases decided by the HIV and AIDS Tribunal in Kenya from 2012 to date. The Tribunal was established in 2009 by the HIV and AIDS Prevention and Control Act (HAPCA) 2006. HAPCA identified different forms of injustices that result from an ‘irrational, panicky and fear-driven’ response to the HIV and AIDS pandemic and established the Tribunal to adjudicate and give appropriate redress in cases involving violations of the provisions of the Act as well as any other written law relating to the categories of rights entrenched in the Act.1 The jurisdiction conferred to the Tribunal excludes criminal jurisdiction.
This Compendium of Cases of the Tribunal therefore aims at supporting lawyers, judges, legal researchers, students, and the general public in understanding and appreciating how the law has been applied and interpreted to protect and promote the rights of PLHIV.
